As your Provider, I agree to deliver your product/s in a timely and mutually agreed upon manner, contingent on the following conditions:

Ordering:

Orders are ONLY confirmed through payment of AT LEAST a 50% deposit of the order total via accepted methods, with the exception of orders made less than 14 days in advance and Signature catalogue orders which require full payment in order to cover procurement needs.

Orders are accepted only through our designated order forms, e-mail, and WhatsApp.

During preparation, products might come into contact with nuts and other allergens. It is The Client’s responsibility to inform us of any food/material allergies.

Order balances must be settled any time before delivery is made. Otherwise, we reserve the right to cancel delivery service and/or withhold product/s included in the order until balances are settled. Clients may request photos of completed product/s before settling balances.

Deposit Refund Policy

Deposits are refundable (minus 25% of the total order cost), only if the cancellation is made at least 5 calendar days prior to the agreed fulfillment date. This 25% fee covers administrative tasks associated with your order and reservation of the date.

Owing to the nature of the business , perishability of materials and the custom nature of some decorative elements, cancellations made within 5 days of the fulfillment date are not eligible for any refund, as the date has been held exclusively for your order and preparations may already be underway. Orders made within 5 days of the fulfillment date are not eligible for a refund in any amount due to cancellations.

Changes:

Changes to an order will be considered for acceptance at our discretion. We cannot guarantee availability of materials/ingredients/enough time for execution to accept changes after an order has been confirmed.

If the changes are accepted and are such that they incur an additional fee, payment of same will be required before the delivery date.

If changes are accepted and we identify that the changes warrant a partial refund, this will be processed as soon as possible by your delivery date, providing bank account details are provided in a timely manner.

This clause is not applicable to Signature catalogue orders for which we do not accept changes/customisations.

Artistic License Disclaimer:

Cakes and desserts made at Bake My Day are handmade. Decorating is done by individuals and is subject to artistic interpretation. Variances in design elements are to be expected as influenced by ingredient availability, seasonal factors, and structural integrity. When ordering, it is The Client’s responsibility to be as specific as possible with clear expectations for the desired product. While photos may be provided as a guide and for inspiration, we cannot provide exact replicas of the work of other artistes/ sketches/ AI generated images.

Please note that handcrafted details (e.g., florals, toppers, piping, lettering) are subject to natural inconsistencies, which are part of the charm and artistry of a custom cake. These differences are not considered defects and do not qualify for refunds, remakes, or exchanges.

Disputes, Product Acceptance, and Damage Liability

We take great care to ensure every order meets our quality, flavor, and structural standards. Upon delivery or pickup, Clients are encouraged to carefully inspect their order immediately or designate someone to do so. Acceptance of the product at the time of delivery or pickup confirms that the item has been received in good condition and meets the agreed-upon design, quantity and quality expectations.

Once a product has been accepted, no refunds, returns, or exchanges will be offered for design, quantity or appearance-related concerns.

In the event that the flavor of the product/s does not match what was displayed on your invoice at the time of order, we will assess the situation on a case-by-case basis. If verified, a partial refund or credit may be offered and will not exceed 30% of the total item cost. Flavor disputes must be reported within 24 hours of delivery and must include a description of the issue, along with photos, corroborated accounts and any remaining product for assessment.

Please note that we are not responsible for any damage or missing items that occur after delivery or pickup. This includes, but is not limited to:

  • Mishandling during Client transport

  • Improper storage (e.g., excessive heat, refrigeration errors)

  • Failure to follow our care or serving instructions

  • Pilferage by venue staff/friends/family etc.

We take every precaution to ensure our cakes are structurally sound and securely packaged. For quality assurance, we may photograph the product at the time of handoff. Responsibility for the product transfers to The Client upon acceptance.

Delivery Timing and Responsibility

We understand the importance of timely delivery and make every effort to ensure your order arrives at the agreed-upon time (and usually do). While we strive for punctuality, delivery times are approximate and may vary slightly due to factors beyond our control, such as traffic, weather, or unexpected delays.

We kindly ask for a 30-minute delivery window around your scheduled time to allow for safe and careful transport of your custom order. In the rare event of a significant delay, we will contact you promptly with updates and revised timing.

If, for any reason, a delivery is not completed within a reasonable time frame and the product can no longer be used for its intended purpose (e.g., a time-sensitive occasion that follows a schedule), a full refund will be processed. This applies only when the delay is due to our error and not external or client-related circumstances and we are not liable for anything other than the cost of the product/s.

We are not liable for delays or incomplete deliveries resulting from:

  • Unavailability of The Client or designated recipient at the delivery location

  • Unpreparedness of delivery/ set up area

  • Unclear delivery instructions from The Client

  • Incorrect or incomplete location details

  • Last-minute changes to the delivery location or time

  • Failure of The Client to inform us of treacherous road conditions/ construction in the area

  • Inability to safely access the delivery site
